Title: question in regards to using someone elses art???
Post by: Kato_pup on May 19, 2011, 01:59:04 pm
So, I have come to a conclusion that I just do not have art skills, or numb chuck skills for that matter. >.< I am gonna continue to learn and try to be a better artist but I can not draw worth crap. Well, I found a picture that another furry artist had done that I am absolutely in love with. I mean it is almost perfect except for a few things. the art is of a white and tan husky and he is standing and you can see his entire body and it shows his private area. so I want to crop the picture so that the bottom half of the husky is not showing. also, I want to change the color of the fur so it is all white. (I am a solid white husky) then I want to change the background color.

I just wonder if doing so would be illegal? I mean I do not want to do anything illegal and I do not want to offend the artist either because I really really like it. I really want to use it as not only my profile pictures, but possible make it a badge id and use it as an example of my fursona as well but I do not want to do anything wrong or illegal. Does anyone know if I did download it, modify it and use it, if that would be wrong or illegal? Should I just ask the artist on his fa account if I can use it? I am afraid if I ask him he will say no but I guess if that is what his wishes are, I can not argue with that. I just think it is perfect and I will be sad. I do not really want to commission someone to do any work for me at the moment. (money is tight)

just wondering what the rules of thumb are on art.

I would think you should ask for permission before you make any modifications to his art, no matter how small they may be.

You should ask, even if its been CC-0'ed, as a general rule of common courtesy (and is required for fully copyrighted or No-Derivatives stuff).

Generally, don't.
Or ask the person if you can use it.
Or get a commission so you can get a professional looking drawing of your fursona.
But in general, NEVER use someone's art without their permission. It's just plain rude and insulting to the artist.

As others have said, Get permission first. Nuff said. ;)

I really want to use it as not only my profile pictures.....

If you use someone else's artwork as your avatar and/or signature, then you need to specify where you got it from and credit who drew it.

Furtopia takes a very strong view regarding art theft.
Quote
Art Theft: Furtopia was created as a safe place for furry artists to share their own creative work. Art theft will not be tolerated on Furtopia in any form. This includes, but is not limited to: sketches, digital drawings, literature, avatars, signature pics, etc. Any of the following may qualify as art theft:

- Tracing another artist's work without giving credit to the original artist
- Using parts of another artist's work in your own art without permission
- Plagiarizing all or part of a story or poem
- Trying to claim another artist's work as your own

Suspected cases of art theft wil be evaluated on a case-by-case basis. Any member who is shown to have violated Furtopia's art theft policy will receive a warning from the staff, and their art and/or posts will be removed if proper credit is not given. Further offenses will result in a permanent ban and/or other disciplinary measures.

OK, that is what I thought. I was going to ask but I just feel really stupid asking. I mean It is not like I am wanting to use his art as is, I want to modify it and that is why I feel stupid asking. I would ask for a commission but honestly, I just do not have the money to be buying commissions for something as small as a badge or a profile picture. I just do not have that kind of money even if it is like $5. I guess I will just have to work up the nerve to ask. I hope he is cool about it and lets me because it is really good and perfect.

hmmmmm
What kind of art style are we talking about? I might have an alternative for you, depending on your prefs.

I really do not know of a particular preference I mean I could show you the artwork I like but other then that. I am not really sure if I have a particular style I like. I mean .... I like sort of cartoony but sort of more realistic as well but not like over realistic... that probably makes no sense lol I would link the artist's FA account but he is not a very PG artist. That is not why I like his art but the one art he did just happened to be perfect.

Man, go for it. Just send that message. (: There are only two possible outcomes:

1) He says yes. You are happy.
2) He says no. No big deal, nothing lost.

There's only one way to find out which is which!

BTW, it's not uncommon in the furry fandom for one artist to draw lineart and for another one to ask if they can color it. Your request isn't all that dissimilar. Try just asking him if you can recolor it to build up your artistic skills. And of course, like Kobuk mentioned, be sure to prominently credit the original artist wherever you use the pic.

Also, also, there might be a strong chance that the artist already has a G version of the pic too. Some of them make two copies of the same artwork. One for the 18+ ers and another for the All Audiances.
