More proof america's legal system is doomed.

Your all gonna crash and burn.

No matter how you do it these days, you cannot help someone out and NOT get bit in the butt. If I actually cared about society right now, I'd be crying.

You know, if I walked aruond in tattered clothing and asked around for money, and someone donated a decent amount to me, I could most likely sue them for giving me the money.

Matter of fact, I could probably sue DirecTV for giving me a satelite dish.

Or sue a chinese restraunt for giving me chinese food.

Or kazaa for letting me dl MP3's.

Hell, I could probably even sue the first person to reply in this topic for replying to it.

Really now, the possibilities here are damn near limitless.

This is absurd, but it's also part of a growing trend of government subsidized stupidity. Nobody wants to take responsibility for their actions anymore, so they turn to the government for hand outs.

Why did she get the donation if she couldn't afford the child? Why was she legally allowed to get the donation?
Why does this guy have to pay for her idiocy?

This gives me a headache. I don't want to get into the large arguement ("debate") that's begging to be started (by me) - it just seems common sense that this whole issue could be side stepped by a simple rule: if you can't afford kids, (provided, of course, the welfare of the children is really what we're concerned about) you're not allowed to have them.

I've read too many stories about undeserving ne'er-do-well's using the government to plunder money from the people who actually (gasp) earned it. I think I'm going to have to stop reading the news... I can't stand this kind of thing!

"A democracy cannot exist as a permanent form of government. It can only exist until the voters discover that they can vote themselves money from the public treasure. From that moment on the majority always votes for the candidates promising the most money from the public treasury, with the result that a democracy always collapses over loose fiscal policy followed by a dictatorship. The average age of the world's great civilizations has been two hundred years. These nations have progressed through the following sequence: from bondage to spiritual faith, from spiritual faith to great courage, from courage to liberty, from liberty to abundance, from abundance to selfishness, from selfishness to complacency from complacency to apathy, from apathy to dependency, from dependency back to bondage."  - Alexander Tyler, speaking about the fall of the Athenian Republic

I heard in discovery channel they already think that this problem is growing out of control and almost pest-like...
so they're thinking in making a rule, to make these people who just makes stupid lawsuits sues to get money, get penalized by having to pay the cost of the jury and case. apart from the lawyers..
that could make the easy-moneymakers to understand and think twice  before going to a jury for a stupid case
making them to remember that law is not a rulet...

Actually, I don't think the decision in this case is as wild or insane as it initially seems.

First, there was a question of proof about what the circumstances of conception were;  unlike most sperm donor cases, there was no written agreement and no witnesses to the agreement.  Please note that the biological parents in this case initially were lovers.  The child was conceived as the affair was waning.  The man alleged he was acting merely as a sperm donor; the woman alleged there was no such agreement.  It came down to a question of who the tryer of fact believed; him or her.  The judge in this case came down on the side of trying to make sure the child was taken care of.

Let's face it, if the guy in this case had picked this woman up in a bar for a one nighter & she became pregnant he'd be liable for child support.  How stupid was this guy?

I think a bigger question with these sperm donor cases is whether the mother really has the legal power to forego child support.  Illinois, among other states, holds that the right of child support belongs to the child, not to the mother, therefore the mother can not agree to support payments below the legally mandated minimum.  It think it remains to be seen whether these guys who acted as sperm donors are going to be presented with a whacking bill. ''

I'd be interested to see a few more details non clarified in the story. They were having an affair, the affair ended at the same time she was said to convince him to be a donor. How do you prove wether she was impregnated during or after the affair ended since it states it was in the same time frame. I'm sure both sides had thier medical "experts" and we see which side won.
Most (all?!'<img'> sperm donations are done thru artificial insemenation, not intercourse. Yet this article leads me to the conclusion that they did this on thier own with the natural method. Now I'm sure not going to believe ANY woman who says " Lets make out, I want you to donate sperm so I can have a kid, but we'll do it ourselves in the bedroom", and I have a hard time believing this story. To me it sounds like someone was a little to careless and doesn't wan't to be held responcible.

Edit: Curiousity got the better of me and I did some more research into this story. The best report that I found was this one  . This was done thru in-vitro fertilization at a clinic, not on thier own. This other article gives some details missing in the AP version, but I now have to agree that the man got the short end of the stick. I'm leaving my previous comments up since I did post them- but I've proven myself incorrect  '<img'>

By the way, Fowler, there's a difference between alimony & child support.  Ask your dad what the difference is; he'll know. ':?:'

Well, child support didnt fit in the description. And since alimony is commonly used to refer to child support, I used alimony instead.

Either way, the point got accross.

Thanks for the research, Sporty.  Was this guy naive!  I, too, will leave my comments up.  I've always understood that sperm donors were the exception when it came to child support, and as an exception their arrangements with the recipient exempting them from the usual legal obligations were subject to strict scrutiny.  I think sperm donors are on precarious ground, tho.  If yo mama can't sign away your rights to support after you're born, what's the basis for allowing her to do it beforehand?  If there's any wiggle room the courts usually come down on the side of the kids.   Beware!
